Woman takes medication not prescribed to her, sues Wal-Mart pharmacy

After picking up her prescription medication at Wal-Mart, Celestine Columbus claims she found an additional prescription in her bag and took the medication. 

Colimbus, 86, was found two days later by a home healthcare professional suffering from dizziness.

On Nov. 26 she filed suit against Wal-Mart Stores in Jefferson County District Court, alleging the mega-retailer failed to provide her with safe and careful service.

According to the lawsuit, on April 6, 2011, Columbus had her routine medical prescriptions filled at the Port Arthur Wal-Mart. When she retrieved them, an additional medication, Suboxone, meant for another customer was included in the bag, which she took thinking it was her usual prescription.

Her homecare health provider found Columbus, who suffers from numerous health ailments, on April 8, 2011, suffering from dizziness and disorientation. She was taken to the hospital and admitted for several days.

The suit accuses Wal-Mart of acting with conscious indifference, entitling Columbus to triple economic damages and money for her mental anguish and attorney’s fees.

Attorney Gordon D. Friesz of McPherson, Hughes, Bradley, Wimberley, Steele and Chatelain in Port Arthur represents the plaintiff.

Judge Milton Shuffield, 136th District Court, is assigned to the case.
