Slip on ramp leads to suit against IHOP

A Beaumont woman is suing a restaurant chain and its owner, alleging she fell on a slippery ramp.

Sandra Thibodeaux filed a lawsuit against Hnreck Nazarian, IHOP and BONA on April 14 in Jefferson County District Court.

Thibodeaux says she tripped on a handicap ramp located at the IHOP at 5875 Eastex Freeway in Beaumont.

"The ramp was too slippery to be safely traversed, as evidenced by the handicapped person she was assisting on the ramp just prior to her fall," the suit states.

Because of the fall, Thibodeaux says she sustained permanent and debilitating injuries to her knee, back and elbow and incurred medical expenses. She also lost earnings and suffered physical pain, mental anguish, disfigurement and impairment, the complaint says.

The defendants should have known about the slippery condition of the ramp and should have fixed the problem, according to the complaint.

They negligently failed to provide a safe place to walk, failed to inspect their premises for a dangerous condition, failed to warn of the dangerous condition, failed to guard against the dangerous condition and failed to keep the ramp dry, the suit states.

Thibodeaux is seeking an unspecified judgment, plus costs, interest and other relief to which she may be entitled.

Mark Sparks of Provost and Umphrey Law Firm in Beaumont will be representing her.

The case has been assigned to Judge Milton Shuffield, 136th District Court.

Jefferson County District Court case number: D183-774.
