A woman has filed suit against the Port Arthur policeman who she says caused a car crash while pursuing another driver.
Kathy Gregory claims she was driving south on Highway 365 in Port Arthur on Sept. 20, 2008, when defendant and Port Arthur policeman Jason Miles attempted to pursue another vehicle driving erratically on the highway.
"In an attempt at pursuit of the third vehicle, Defendant Jason Miles travelled in to the inside lane on Highway 365 in front of Plaintiff's vehicle, causing her to apply her brakes and skid/slide into Defendant's vehicle," the suit states.
Because of the accident, Gregory incurred medical costs, experienced physical pain and suffering, lost earnings and sustained property damages of $5,000, the complaint says. In addition, she claims she sustained mental anguish.
Miles negligently failed to keep a proper lookout, failed to turn his vehicle to the right, failed to keep the same distance a person using ordinary care would have kept and drove too fast, according to the complaint.
Gregory also names the Port Arthur Police Department as a defendant in the suit, saying it is responsible for the actions of its employees.
In her complaint, Gregory is seeking damages within the jurisdictional limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief to which she may be entitled.
She will be represented by Todd W. LeBlanc of Beaumont.
The case has been assigned to Judge Milton Shuffield, 136th District Court.
