Three plaintiffs seek $1M over auto wreck in La Marque

GALVESTON - Three Galveston County residents are seeking $1 million from a Baytown construction company after an accident with one of its vehicles.

Ruby Birch, Frank Revia and Alexandria Underwood claim that on July 17 a vehicle belonging to Angel Brothers Enterprises Ltd struck their vehicle while it was stopped at an intersection in La Marque.

According to the original petition filed Sept. 24 in Galveston County District Court, the defendant's vehicle reversed into them. The plaintiffs insist their vehicle was unable to back up because another one was behind it.

"The construction vehicle owned by the defendant then rammed into the vehicle driven by plaintiff Ruby Birch," the suit says.

"The collision was moderating causing some damage to plaintiff Ruby Birch's vehicle, and all three plaintiffs were injured by the impact."

Birch, Revia and Underwood claim their injuries are moderately severe and debilitating.

The suit does not identify the driver of the Angel Brothers' vehicle, but invokes the writ of respondeat superior.

In addition to the specified monetary damages, a jury trial is requested.

The Pinkerton Law Firm is representing the plaintiffs, and Galveston County 122nd District Court Judge John Ellisor is presiding over the case.
