Man claims Galveston condo rented out without permission

GALVESTON - A Harris County man has filed a $100,000 lawsuit against his condominium complex in Galveston alleging his unit was rented out without his permission.

Mike Dayyani claims he purchased property at The Palms At Cove View in August 2008 only to have it illegally occupied by someone else three months later, the suit filed Oct. 8 in Galveston County District Court says.

Dayanni explains that the defendant's management team did not consult with him prior to leasing his unit to a third party. He learned that The Palms executed a rental contract --with a rental rate of $1,400 per month-- which indicated The Palms was the owner of the condominium, the suit states.

The plaintiff argues that the alleged trespassing precluded him from using and enjoying his condominium. He also insists "his personal property was converted or otherwise lost."

"Mr. Dayyani has also incurred expenses associated with repairing damages to the condominium," the original petition says.

In addition to the specified monetary damages, a jury trial is requested.

The Hudgins Law Firm is representing Dayyani, and Galveston County 212th District Court Judge Susan Criss is presiding over the case.
