Woman falls off toilet, sues McDonald's

Two years ago, Jasper resident Bettie Haley-Ozan was dining at a Beaumont McDonald's and while visiting the bathroom she fell off the toilet, "due to a broken toilet seat."

Haley-Ozan filed suit against R.E.E. Inc., doing business as McDonald's, on Nov. 12 in Jefferson County District Court.

Court papers show that on Dec. 11, 2008, Haley-Ozan was eating at the McDonald's located at 190 North and Interstate 10.

She "had visited the restroom when she fell due to a broken toilet seat."

"The store manager confirmed that he was aware of the broken toilet seat," the suit states, adding that restaurant owed her a duty to warn her of the danger and eliminate such risks from its premises.

Haley-Ozan is suing for her alleged past and future mental anguish, pain, medical expenses, lost earnings and impairment.

She is represented by Beaumont attorney Jonathan Juhan.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.
