Child falls out of shopping cart, parents sue Sutherland's

The parents of a young boy have filed suit against Sutherland's in Beaumont, alleging the company is responsible for their son falling out of a shopping cart.

Connie and Edward Stunkard filed the suit Nov. 12 in Jefferson County District Court.

Court papers show that on Feb. 19, 2009, the minor child was in a shopping cart at the lumber store when he "fell from the cart and sustained injuries."

The suit fails to state how the child fell from the cart and if he was being supervised by the parents at the time of the incident. The suit also fails to list a single act of negligence on Sutherland's part.

The Stunkards are seeking to recover a judgment of more than $75,000.

They are represented by Dallas attorney Keith Purdue.

Judge Donald Floyd, 172nd District Court, has been assigned to the case.
