Blue Bell sues over damage to ice cream truck

Blue Bell Creameries is suing Beaumont resident Dominique Acevedo for damaging one of its ice cream delivery trucks.

The suit was filed Nov. 29 in Jefferson County District Court.

Court papers show that on Feb. 18, 2009, Acevedo steered his vehicle into a Ford Truck and then hit the left rear side of a Blue Bell delivery truck, which was stopped for a red light at the corner of Major Drive and College Street.

In its suit, Brenham-based Blue Bell alleges Acevedo negligently failed to control his speed and the collision he caused resulted in the cave in of the left side of the truck.

The delivery truck is a 2002 International Bobtail, court papers say.

Blue Bell contends the truck was in "first-class condition" before the collision.

The company is seeking $13,417.87 for the cost of repairing the truck, plus an additional $4,000 in consequential damages.

Blue Bell is represented by Houston attorney Michael Wright.

Judge Bob Wortham, 58th District Court, has been assigned to the case.
