TYLER - A consumer has filed a lawsuit against an East Texas collection law firm for violating the Fair Debt Collection Practices Act.
Canton resident Frances Glasgow filed suit against Michael J. Scott PC in Carrollton on Jan. 4 in the Eastern District of Texas, Tyler Division.
According to the firm's website, "The attorneys of Michael J Scott PC work for some of the largest collectors of debt in the country; ranging from credit card collections and foreclosures, to full commercial litigation and judgment enforcement."
The defendant is attempting to collect a debt on behalf of an original creditor. Glasgow states he sent a cease-and-desist letter to the law firm, but the law firm still attempted to collect on the debt.
The law firm is accused of violating the Act by attempting to contact Glasgow even though it knew he was represented by an attorney.
Glasgow is asking for an award of statutory damages of $1,000, plus court costs and reasonably attorney's fees.
The plaintiff is represented by Michael S. Agruss of Krohn & Moss Ltd. in Los Angeles,
Calif.
A jury trial is requested.
U.S. District Judge Leonard E. Davis is assigned to the case.
