MARSHALL - The family of a deceased Tyler woman alleges her seatbelt restraint system failed to comply with appropriate legal statutes, a federal lawsuit filed against the seatbelt manufacturer states.
Clint Bryant, Kimberly Tabb, Ann Anderson and James Dozier, individually and as representative of the estate of Sandra Dozier, filed suit against TRW Vehicle Safety Systems Inc. on Jan. 7 in the Eastern District of Texas, Marshall Division.
On March 13, 2007, Sandra Dozier was driving a 1998 Pontiac Grand Prix westbound on State Highway 31 in Smith County. According to court records, Dozier lost control of the Grand Prix and it rolled over.
Even though Dozier was wearing a seatbelt at the time of the collision, the lawsuit states, her injuries were fatal.
TRW Vehicle Safety Systems is accused of designing and manufacturing an unreasonably dangerous restraint system.
Specifically, the lawsuit states that the buckle on the seatbelt fails to provide adequate or proper restraint, fails to comply with legal statutes, violates GM's internal specifications and violates the principles of crashworthiness.
The family is seeking damages for loss of care, maintenance, support, services, advice, counsel, loss of pecuniary contributions, loss of companionship and society, loss of consortium, loss of inheritance emotional distress, mental anguish, medical and funeral expenses, interest and court costs.
The plaintiffs are represented by E. Todd Tracy and I. Scott Lidji of The Tracy Firm in Dallas.
U.S. District Judge T. John Ward is assigned to the case.
