Pedestrian struck by city vehicle sues Galveston

GALVESTON - After being hit while walking near the Galveston Seawall, Alejandra Leal is suing Alfred James Paige and the city of Galveston.

In a lawsuit filed Jan. 24 in Galveston County District Court, plaintiff Leal claims she was crossing the street in the 5200 of Fort Crockett Boulevard on Nov. 3, 2010, when Paige turned left out of a private drive and collided with her.

The suit argues that the motorist "failed to yield to a pedestrian and struck (her) with great force and violence. Leal insists "nothing she did nor failed to do caused or in any way contributed to cause the occurrence in question or the resulting injuries and damages she sustained."

The city is named a defendant in the case because Paige was driving a city vehicle at the time of the collision.

Leal consequently seeks unspecified monetary damages.

She is represented by Matthews & Forester.

The case has been assigned to Galveston County 56th District Court Judge Lonnie Cox.
