Slip & fall filed against Texas Roadhouse

Area resident Lindsay Boggs has filed suit against the Texas Roadhouse in Port Arthur, claiming she slipped and fell at the restaurant because of a dangerous condition.

The suit was filed Feb. 28 in Jefferson County District Court.

According to her petition, on Dec. 23, 2009, Boggs was dining at the establishment when she slipped and fell.

The suit does not state what caused Boggs to slip or what she was doing at the time.

The suit only alleges the incident transpired through no negligence on her behalf and that Texas Roadhouse negligently failed to remedy the unknown "dangerous condition."

She also alleges the restaurant failed to warn customers of the danger and take care of its floors.

On top of exemplary damages, Boggs is suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Beaumont attorney John Lane of Provost Umphrey represents her.

Judge Bob Wortham, 58th District Court, has been assigned to the case.
