GALVESTON The city of League City filed a motion of summary judgment in a Pakistani journalist's lawsuit, recent court documents say.
As previously reported, League City is among the defendants named in Pasadena resident Manzoor A. Memon's suit against Syed Rashid Bukhari, which was filed last Sept. 21 before the Galveston County 10th District Court.
Memon claims Bukhari, a fellow Pakistani, assaulted him in the parking lot of Hometown Bank of League City after a chance encounter last March.
He blames both the bank and the League City Police Department failed to help him resolve the situation, stressing both entities sided with Bukhari.
Memon was investigating Bukhari for a news story into the man's alleged financial misconduct and was at the bank to obtain information on Bukhari's monetary dealings, according to the original petition.
The city seeks a summary judgment on the basis that it is immune from the intentional tort claims and it had no duty to investigate Memon's complaint against his daughter's father-in-law, the six-page motion says.
It stresses governmental immunity that can be waived "only if liability can be established under the limited circumstances specified pursuant to the Texas Tort Claims Act" and requests that any claims against the city be dismissed with prejudice.
Olson & Olson LLP is representing the city.
