Wal-Mart employee told to 'hurry up,' files racial discrimination lawsuit

MARSHALL - A Wal-Mart stocker has filed a racial discrimination lawsuit against the company after he was yelled at by his supervisor.

Jerry Joshua filed suit against Wal-Mart Stores Inc. on June 27 in the Eastern District of Texas, Marshall Division.

Joshua states the Wal-Mart manager created a hostile work environment by making comments such as "hurry up" and "you are too slow."

According to the complaint, Joshua, a native of the Island of Palau, has a strong Asian accent and is dark skinned.

The defendant is accused of discrimination for failing to equalize conditions of employment for Joshua as contrasted with Caucasian employees, adopting unreasonable, unwarranted and arbitrary standards and conditions of employment and advancement designed to discriminate and denying Joshua positions of employment and promotions because he is a native of the Island of Palau.

The plaintiff is seeking damages for adjusted pay, interest, liquidated damages, mental distress, emotional pain and suffering, inconvenience, loss of enjoyment of life, punitive damages, attorney's fees and court costs.

Joshua is represented by Tyler attorney William S. Hommel Jr. A jury trial is requested.

U.S. District Judge David Folsom is assigned to the case.
