Daughter claims negligent care led to father's death at nursing home

GALVESTON - Alleging her father died because of negligent care at a Texas City nursing home rehabilitation facility, Elaine Carrier has filed a lawsuit.

Carrier filed suit against Seabreeze Nursing & Rehabilitation, Dr. Folasade Mofolu Ojo, Cabrenna Lee and Tonya L. Green on Oct. 17 in Galveston County District Court.

She alleges the defendants failed to treat her father, decedent Willie Gamble Sr., for bed sores and left him malnourished, which led to his death on Oct. 13, 2009.

According to the suit, Gamble was a patient at the facility for seven years. Carrier says she notified the staff of her father's problems, but they "did not exercise ordinary care in making health-care treatment decisions regarding the decedent."

"The defendants' lack of ordinary care proximately caused injury to the plaintiff, which resulted in the death of the decedent," the original petition says.

"The defendant physician (Ojo) breached the duty of care that he owed to the decedent by failing to properly diagnose his injuries and preventing a lack of nourishment and bed sores from developing on the decedent."

The suit alleges that Gamble suffered physical and emotional injuries as a result of the defendants' actions before his death.

Carrier seeks unspecified monetary damages and a jury trial.

She is represented by attorney Rodney E. Moton of Houston.

The case has been assigned to Galveston County 10th District Court Judge David Garner.
