A man has filed suit against his former employers, alleging he developed bladder cancer after being exposed to carcinogenic materials throughout his career.
William Boudreaux claims he worked as a journeyman machinist and a machinist mechanic at the Texas U.S. and Ameripol-Synpol Corp. facility in Port Neches from 1966 until 1997.
During his employment, Boudreaux was exposed to nitrates, according to the complaint filed Nov. 16 in Jefferson County District Court.
Because of his exposure to the chemicals, Boudreaux developed bladder cancer and experienced physical pain, suffering and mental anguish, the suit states. In addition, he sustained disfigurement and lost wages, the complaint says.
His wife, Jean Boudreaux, is also a plaintiff. She claims she lost her husband's affection, solace, comfort, companionship, society, assistance and sexual relations because of his exposure.
The complaint names Arkema, Ashland Oil, Atlantic Richfield Co., Bridgestone Americas Tire Operations, Cabot Corp., Chemtura Corp., Chevron Phillips Chemical Co., Chevron, ConocoPhillips Co., The Dow Chemical Co., E.I. DuPont Denumours Co., Exxon Mobil Corp., General Electric Co., Goodrich, Huntsman Petrochemical Corp., Meadwestvaco Corp., Meadwestvaco Texas, Nalco Co., R.T. Vanderbilt Co., Rohm and Hass Co., Shell Chemical, Shell Oil Co., Sunoco, Texaco, Texaco Refining and Marketing, TRMI Holdings, Union Carbide, Uniroyal and Union Oil Company of California as defendants.
The defendants negligently failed to provide adequate warnings about potential exposure to carcinogens, failed to test the human health effects of carcinogens, failed to recommend workers use personal protective equipment when working near the chemicals, failed to monitor those who worked near the chemicals and failed to place a safer product into use, according to the complaint.
The Boudreauxs allege strict liability, negligence, intentional conduct, gross negligence and fraudulent concealment against the defendants.
In their complaint, the Boudreauxs are seeking an unspecified judgment, plus interest at the legal rate, costs and other relief the court deems just.
