GALVESTON - A League City resident has non-suited one of the defendants in his lawsuit over the loss of his eye during a Halloween 2010 boat ride.
Court records show plaintiff Charles Strahan moved to non-suit Turtle Entertainment LLC without prejudice June 4.
Strahan sued Turtle Entertainment, Orion Ventures Inc. and League City resident Darrell Shannon on Dec. 12, 2011, in Galveston County 56th District Court.
The original petition alleges that Shannon was intoxicated during the early morning hours of Oct. 31, 2010, when he operated his boat with Strahan and co-plaintiff Jenny Shetler as passengers.
Prior to the ride, the suit alleges that Shannon had drinks at Lance's Turtle Bar, which is owned and operated by Orion Ventures and Turtle Entertainment.
Toward the end of the ride, Shannon allegedly told Strahan to stick his head off the side of the boat to look for a harbor marker. Strahan claims that "in his drunken state," Shannon drove the boat too close to the marker and Strahan was struck.
Strahan suffered severe injuries to his face and frontal lobe and also lost an eye, according to the suit.
Shannon provided an original answer to the allegations while Orion Ventures filed an original cross claim against the former and Turtle Entertainment.
Orion Ventures itself was non-suited by the plaintiffs on April 18.
The suit now targets only Shannon.
