Mount Pleasant nursing home faces wrongful death lawsuit

MARSHALL - The family of patient at a Mount Pleasant nursing home has filed a wrongful death lawsuit that claims the nursing home failed to adequately treat a urinary tract infection which led to the patient's death.

Florence L. French, individually and as representative of the estate of Imer D. Newman, deceased; Bonnie LeRoy, Carolyn Newman, LeRoy Newman; and James Newman filed suit against Nexion Health at Mount Pleasant Inc., doing business as Mount Pleasant Healthcare Center on Dec. 21 in the Eastern District of Texas, Marshall Division.

According to the lawsuit, Imer D. Newman was a patient at the nursing home on Dec. 27, 2010, when she developed a urinary tract infection. The infection allegedly went untreated and spread to her bloodstream. Newman was transported to a local hospital on Jan. 2, 2011, for treatment, but she died three days later from a blood borne infection, the suit states.

The defendant is accused of negligence for failing to meet the applicable standard of care in the treatment and care of Newman.

Specifically, the defendant is accused of:

Failure to asses and report signs and symptoms of urinary tract infection;

Failure to appropriately monitor blood pressure;

Inappropriate administration of antihypertensive medication in a hypotensive patient;

Failure to maintain oxygen saturations, failure to provide adequate intravenous resuscitation; and

Failure to document patient condition and for inappropriate alteration of facts in patient’s medical records.

The lawsuit is seeking an award of wrongful death damages and survival damages for loss of companionship and society, mental anguish, emotional pain, torment and suffering, physical pain and suffering, medical expenses, funeral and burial expenses, exemplary damages, interest and court costs.

The plaintiffs are represented by M. Raymond Hatcher, Carson R. Runge and Alan J. Robertson of Sloan, Bagley, Hatcher & Perry Law Firm in Longview.

A jury trial is requested.
