Lawsuit filed over deadly tractor-trailer wreck on Hwy 84

MARSHALL - The parents of two deceased Texas women have filed a lawsuit over the deadly tractor-trailer wreck that occurred in July 2012 on Highway 84 after the tractor-trailer ran through a stop sign and hit the women’s vehicle. 

Prentice Wilson and Elizabeth Wilson, each individually and as a statutory beneficiary of Georgia Ann Wilson and Laura Deemer, individually and as a statutory beneficiary of Carly Mary Rose Deemer, filed suit against John R. Cline and Dransco Inc. on Feb. 20 in the Eastern District of Texas, Marshall Division.

The incident occurred at around 7:30 a.m., July 26, 2012, as Carly Mary Rose Deemer was operating her vehicle in a westerly direction in the outside lane of U.S. Highway 84 at its intersection with U.S. Interstate 49. Georgia Ann Wilson was a guest passenger in the Deemer vehicle.

Defendant Cline was operating a tractor-trailer rig in a southerly direction on the southbound I-49 exit ramp when he chose to disregard the stop signs showing in his direction of travel, failed to yield the right of way to the Deemer vehicle and caused a collision with her vehicle.

Deemer and Wilson suffered fatal injuries in the collision.

Defendant Cline is accused of negligence for failing to maintain a proper lookout, failing to obey traffic controls, i.e. the stop signs showing in his direction of travel, failing to yield the right of way to the Deemer vehicle, entering the intersection with U.S. Highway 84 when it was unsafe, failing to timely apply brakes and for failing to maintain proper control of his vehicle.

The surviving parents of Wilson and the parent of Deemer are asking for an award of damages for pecuniary losses, loss of care, maintenance, support, services, counsel, loss of companionship and society, loss of the positive benefits, and damages for Wilson’s emotional pain, torment, mental anguish and suffering, and funeral and burial expenses.

The plaintiffs are represented by Shreveport, La., attorney M. Carl Rice of Rice & Kendig.

A jury trial is requested.

U.S. District Judge Rodney Gilstrap is assigned to the case.
