$5M wrongful death suit brought following fatal collision

Seeking more than $5 million in damages, the estate of Higinio Gonzalez has filed suit against Alban Vanzandt and Clean Harbors Industrial Services, blaming the defendants for the auto collision that claimed Gonzalez’s life.

Jessica Gonzalez filed the suit May 24 in Jefferson County District Court.

According to the lawsuit, on April 9, 2013, Higinio was a passenger in a vehicle being driven by Vanandt in Wichita, Kan., when he lost control and crashed, resulting in Higinio’s death.

At the time of the incident, Vanandt was driving a vehicle leased by Clean Harbors Industrial Services.

Vanzandt is accused of negligently operating the vehicle while intoxicated, and CHIS is faulted with negligent entrustment, the suit states.

The plaintiffs are seeking wrongful death damages and are also suing for Higinio’s pain, lost wages, medical expenses and mental anguish.

Bellaire attorney Jeffrey Stern represents them.

Judge Gary Sanderson, 60th District Court, is assigned to the case.
