Trucking company sued following rear-end collision on Hwy 75 in McKinney

SHERMAN - A Denison woman has filed a lawsuit against a trucking company claiming the company is responsible for the injuries she received in a rear-end collision involving a tractor-trailer on Highway 75 in McKinney. 

Georgia Durst filed suit against Robert P. Haithcock and Parsons Trucking Co. Inc. on May 22, 2013 in Collin County District Court. The defendants removed the case to the Eastern District of Texas, Sherman Division on June 28.

The accident occurred on May 24, 2011 on southbound Highway 75 in McKinney. Durst was operating her 2011 Toyota Avalon in a southerly direction when she was rear-ended by a 2004 Freightliner, tractor-trailer rig.

Defendant Haithcock is accused of failing to maintain an assured clear distance between his vehicle, failing to timely apply his brakes, failing to keep his vehicle under control, failing to swerve to left to avoid a collision, failing to keep a proper lookout, failing to discontinue driving when not physically or mentally alert to safely continue driving and/or failing to maintain a reasonable speed or to control speed.

Defendant Parson is accused of failing to ensure that Haithcock drove in compliance with all federal regulations, failing to properly screen Haithcock proper to his employment, and for failing to adequately train Haithcock.

The plaintiff is seeking an award of damages for bodily injuries, physical and mental pain, suffering and anguish, medical expenses, physical impairment, diminished earning capacity, inability to perform household services, interest and court costs.
