Frito-Lay sales rep. files age discrimination suit

SHERMAN - A Frito-Lay sales representative has filed a discrimination lawsuit claiming he was fired because of his age.

Steven Hunter filed suit against Rolling Frito-Lay Sales and Frito-Lay Inc. on July 3 in the Eastern District of Texas, Sherman Division. 

Hunter worked for the defendants for approximately 17 years. At the time of his discharge, he was employed as a Route Sales Representative and worked out of the defendants' Sherman warehouse. On June 8, 2012, Hunter was suspended for having his son with him on his sales route. According to the lawsuit, Hunter had been called into work on his day off, which was also his day with his son.

About a week later, Hunter claims he was called to meet with his supervisor and informed he could either sign a letter requesting retirement or be terminated. He was 58 years of age at the time of his discharge.

The defendant is accused of age discrimination in violation of the Employment Act.

The plaintiff is seeking an award of actual damages, interest, liquidated damages, mental anguish, punitive damages, attorney’s fees, court costs and interest.

Hunter is represented by Sherman attorney Ronald R. Huff. A jury trial is requested.

U.S. District Judge Richard A. Schell is assigned to the case.
