Plano resident sues debt collector over threats to file criminal case

SHERMAN - A Plano resident has filed a lawsuit against a debt collector claiming that a company representative falsely threatened to file a criminal case.

Gale Hutchinson, also known as Corbett Hutchinson, filed suit against Commercial Recovery Systems Inc. on Sept. 16 in the Eastern District of Texas, Sherman Division. 

Hutchinson alleges that one of defendant’s representatives falsely represented that he was an attorney and threatened to file a criminal case against Hutchinson.

The defendant is accused of violating the Fair Debt Collection Practices Act by using false, deceptive and misleading representations in connection with the collection of any debt, by falsely threatening to initiate criminal proceedings against Hutchinson and by using deceptive means in an attempt to collect a debt, according to the suit.

Hutchinson is seeking an award of actual damages for embarrassment, humiliation, mental anguish, emotional distress, anxiety, inconvenience, and the disruption of his day, statutory damages, court costs and attorney’s fees.

The plaintiff is represented by Ryan Lee of Krohn & Moss Ltd. in Los Angeles, Calif.

U.S. District Judge Ron Clark is assigned to the case.
