Worker files racial discrimination lawsuit against Arlington company

MARSHALL - A worker who tried to implement safety measures at his job is suing for racial discrimination claiming he was terminated after a campaign of retaliation.

Rickey C. Wilson filed suit against Andritz Separation Inc. on Oct. 7 in Camp County District Court. The defendant removed the case to the Eastern District of Texas, Marshall Division on Nov. 21.

Wilson was employed by the defendant as a machinist, but was later given a position over Quality Control and Safety.

Wilson states he tried to implement several measures to promote a safe working environment, while meeting standards of the Occupational Safety and Health Administration. He claims that following these measures he had to endure a hostile work environment, which led to his termination in May 2013.

Specifically, Wilson claims that the defendant “instituted a campaign of retaliation which included name calling, cussing, and making disparaging remarks about the Plaintiff."

The defendant is accused of race and color discrimination and constructive discharge.

The plaintiff is seeking an award of damages for front pay, back pay, inconvenience, medical expenses, loss of earning capacity, loss of benefits, court costs, exemplary damages and interest.

Wilson is represented by Gilmer attorney Matthew R. Patton IV.

U.S. District Judge Rodney Gilstrap is assigned to the case.
