Bank sues heirs seeking foreclosure of Port Arthur home

A bank has filed an order for foreclosure on a property in the city of Port Arthur.

Capital One NA filed a lawsuit on Jan. 16 in the Jefferson County District Court against Johnny "Tyrone" Jones, The Unknown Heirs at Law of the deceased W.C. Jones, The Unknown Heirs at Law of the deceased Uvonne Jones and The Unknown Heirs at Law of the deceased Michael Jones in regards to 3823 Memorial Blvd., Port Arthur, Texas 77642, citing an order for foreclosure.

The plaintiff alleges it has not received any payments under the Loan Agreement with the defendants since September 2012.

The bank is calling on the heirs of the deceased defendants to give up their rights, title and interest in the property. The defendants will not be held personally responsible for the debt, according to the suit.

The plaintiff is seeking foreclosure on the property and other relief agreed on by the court.

The loan company is being represented in the case by attorney Lauren E. Christoffel of Barrett Daffin Frappier Turner & Engel LLP in Addison.
