Dwight Talton filed suit in the Jefferson County District Court on Jan. 23, naming Overseas Enterprises USA Inc., doing business as Neighborly Store, as the defendant. Talton is suing over injuries he allegedly sustained when he fell at the defendant's store.
According to Talton, on March 31, 2012, he walked into the Neighborly Store on N. Major Drive in Beaumont, when he slipped and fell. Talton claims there was an accumulation of a clear liquid on the ground which had been oozing out of a freezer and caused him to fall when he stepped in it.
The plaintiff alleges the liquid on the ground created a dangerous condition and the storeowner was negligent by failing to wipe it up or block it off the area.
Talton claims he was severely injured in the accident and seeks to hold the defendant liable. Talton is seeking an undisclosed amount in damages.
