A driver is suing the man he alleges was texting while driving and caused a wreck.
Ramon Renteria Jr. filed a lawsuit Jan. 30 in the Galveston County District Court against Evan Joseph Gardner and John E. Gardner, citing negligence.
The lawsuit states on Jan. 20, Renteria was traveling north on State Highway 6 near Township Lane in Missouri City when he was rear ended, allegedly by Evan Gardner.
According to the lawsuit, Evan Gardner was allegedly using his cell phone to send and receive texts while he was driving a vehicle owned by John Gardner.
Renteria claims he has suffered personal injuries, medical bills and damage to his vehicle. He is seeking monetary relief less than $100,000 including penalties, costs, expenses, pre-judgment interest and attorney’s fees.
