Marathon Petroleum sued after worker injured in explosion

A Galveston County man is suing over claims he was severely injured in an explosion at a refinery that occurred when a flare line was improperly isolated.


Oscar Garcia filed a lawsuit March 28 in the Galveston County District Court against Marathon Petroleum Co. L.P., citing gross negligence.

According to the complaint, Garcia was working for his employer, Wyatt Field Services, on the flare line at Marathon's CPR2 unit on Feb. 21, when an explosion erupted, severely injuring Garcia. 

Garcia says Marathon employees failed to react properly and assist him when his body caught on fire.

Marathon is accused of failing to properly isolate the line and misinforming Garcia that no special tools or protective equipment was needed.

Garcia is seeking punitive damages in an amount to be determined by the court.

He is being represented in the case by attorneys Anthony G. Buzbee and Daniel Wilson.
