A Fort Bend County resident is suing after being terminated from her employment with Garden Terrace Alzheimer's Center of Excellence.
Juvon Wilson filed a lawsuit March 25 in the Houston Division of the United States Court for the Southern District of Texas against Life Care Centers of America, doing business as Garden Terrace Alzheimer's Center of Excellence, citing violations of the Family Medical Leave Act and violations under the Texas Workers’ Compensation Act.
The complaint states the plaintiff began working as an RTA restorative activities assistant for the defendant on March 21, 2000.
On Nov. 16, 2012, Wilson states she was injured in the course of her employment and placed on light duty with restrictions, according to the complaint. The plaintiff alleges the defendant did not follow the light duty restrictions.
The complaint says the plaintiff collapsed while at work on Dec. 19. Wilson states she was terminated on Jan. 8, allegedly for insubordination.
The plaintiff alleges she was terminated in retaliation for exercising her rights under the Texas Workers’ Compensation Act and the Family and Medical Leave Act.
Wilson is seeking damages within the jurisdictional limits, exemplary damages, costs and fees.
