Woman demands ex-husband sell home

A woman is suing her former husband, stating he hid facts during their divorce that caused an unequal division of property.

Annette Celeste Alvarado filed suit June 2 in Galveston County District Court against David Wayne Caterisano.  According to the complaint, the named parties were married from May 20, 2005, until Nov. 14, 2008. At the time of the divorce, the home they shared was not divided because the defendant alleged it was in foreclosure. Alvarado, however, discovered Caterisano was still living in the home in 2013 and that it had never been in foreclosure, the suit claims. As a result, the plaintiff states the division of property following the divorce was unjust and she is demanding the sale of the home with proceeds to be divided between the two parties.

The defendant is accused of breach of contract, breach of fiduciary duty, fraud by nondisclosure and common-law fraud.

Alvarado is seeking a temporary restraining order, damages to be determined by the court and costs. She is represented by attorneys Leslie Wm. Adams and Angelle M. Adams.
