Woman claims medical costs following collision

A woman has filed suit against the driver she claims failed to yield the right-of-way and struck her vehicle.

Margy Free filed a lawsuit July 28 in the U.S. District Court for the Eastern District of Texas Marshall Division against Stephen Dale Trull and All Around Underground.

In her complaint, Free alleges she was driving north on Robert Wilson Road outside the Longview city limits on Dec. 10. At the same time, Trull was driving west in a private drive and was towing a trailer, according to the complaint. He failed to yield the right-of-way and struck Free's vehicle, the suit states.

Because of the collision, Free claims she incurred medical costs, suffered physical pain and mental anguish and incurred medical costs. She also suffered physical impairment and endured disfigurement, according to the complaint.

Trull negligently failed to properly and timely apply his brakes, failed to keep a proper lookout, failed to pay attention, drove without regard for the safety of other people, drove recklessly and failed to take evasive action, the suit states.

Free is seeking compensatory damages, plus pre- and post-judgment interest, costs and other relief the court deems just.
