Texas business claims it was not paid for labor, materials

A Texas business claims it was not paid more than $40,000 for work and materials.

Pentair Thermal Management claims defendants Brenda Richard and Jeffrey A. Richard, doing business as Instrumentation Technologies and Components, requested that it supply labor and materials to them.

Pentair provided the requested services and charged $50,329.30 for them, according to the complaint filed Aug. 27 in Jefferson County District Court.

"Defendants failed to pay $45,296.37 of the $50,329.30 due for the labor and/or materials provided for the benefit of Pentair," the suit states.

In its complaint, Pentair alleges breach of contract, negligent misrepresentation and unjust enrichment against the defendants.

It seeks the money it claims the defendants owe it, plus pre- and post-judgment interest, attorneys' fees and other relief the court deems just.

Richard D. Weaver and James Hamilton Foley of The Weaver Law Firm in Houston will be representing it.
