Man claims spinal injuries in collision

A Corpus Christi man has filed suit against the driver who he claims caused a multi-car collision, causing him to sustain spinal injuries.

Josue Rios and Ricardo Cruz claim they were at a complete stop on Oct. 9, 2012, when their vehicle was suddenly struck by defendant Justin Lee Brower. 

At the time of the collision, Brower was working for defendant Oceaneering International and was traveling north on FM 2725 preparing to turn left, according to the complaint filed Sept. 4 in Jefferson County District Court.

Defendant Mark Dale Dugas was at the same intersection traveling south for defendant AAE Acquisition, the suit states.

"Defendant Justin Lee Brower was negligent when he struck defendant Mark Dale Dugas therefore causing him to strike plaintiffs," the complaint says. "Defendant Justin Lee Brower received traffic citations for driving while license invalid and failing to yield row turning left. Defendant Mark Dale Dugas was negligent in failing to timely apply his brakes or take evasive measures to avoid the collision."

Due to the collision, Rios and Cruz suffered injuries to their necks and backs; endured a deteriorating mental and physical condition; and incurred medical costs, the complaint says. They also suffered physical impairment and physical disfigurement, lost wages, experienced pain and suffering and endured mental anguish, they claim.

In their complaint, the plaintiffs seek a judgment within the jurisdictional limits of the court, plus pre- and post-judgment interest, costs and other relief the court deems just.
