A Grayson County man has filed suit against his former employer, citing an alleged violation of the Americans with Disabilities Act (ADA) of 1990 and discrimination.
Marshall Ward brought charges against Grayson County in Sherman, in the U.S. District Court for the Eastern District of Texas, Sherman Division, on Jan. 30, alleging discrimination, denial of reasonable accommodation and wrongful termination.
The plaintiff, who was employed by Grayson County for over 20 years as a sanitarian in the health department, suffered a seizure in July 2012 and was subsequently diagnosed with epilepsy and adult onset seizure disorder.
In late August 2012, he was demoted to a position with a lower pay rate. On Oct. 17, the plaintiff was placed on suspension for “violating policies” and was terminated on Oct. 25, after being accused of sexual harassment.
Ward denies the allegations and claims that his supervisor never cited evidence of inappropriate behavior. He filed a complaint with the Equal Employment Opportunity Commission (EEOC) on Feb. 4, 2014 and received notice of the right to sue from the Justice Department on Nov. 24, 2014.
The plaintiff seeks compensation for duress, attorney fees, expenses and costs. He is represented by attorney Ronald Huff of Sherman.
