Woman names Walmart in slip-and-fall suit

A consumer has sued Walmart, alleging negligence in a 2013 incident.

Debra Garcia filed a complaint April 23 in the Beaumont Division of the Eastern District of Texas against Wal-Mart Stores Inc., alleging negligence and premises liability.

According to the complaint, on Dec. 20, 2013, Garcia fell while on the premises of a Walmart at 831 Highway 59 S., Cleveland,
and she slipped as a result of an unreasonably dangerous condition caused by liquid on the floor.

Garcia alleges Walmart failed to: construct its store’s walking surface with non-slip materials; maintain, inspect, and repair the premises as necessary; and warn her of the hazard. The suit says the store failed to train its employees to manage conditions.

The plaintiff cites pain and suffering, anguish, medical expenses, past and future physical impairment and/or disfigurement.

Garcia seeks $375,000 in compensation for medical expenses, damages, attorney fees, expenses and costs. She is represented by attorney Scot Dollinger of Dollinger Law in Houston.
