Car owner sues woman who rear-ended his daughter

A Harris County father filed a lawsuit against a League City woman alleging vehicular negligence in a 2015 collision that damaged his car and hurt his daughter.

Ty Holland filed individually and as next friend to Jady Holland against Kaitlyn Clute in Galveston County District Court on June 9, claiming liability in a May motor vehicle collision.

According to the suit, Clute’s negligence caused damages to a 2003 Hyundai Elantra driven by Jady Holland and owned by Ty Holland. The complaint states that on or about May 8 Jady was driving north on Lawrence Road and stopped for a red light at the intersection with East League City Parkway, when Clute rear-ended her.

The suit states that Clute failed to control her speed or the vehicle, pay attention, maintain a proper lookout, apply her brakes in a timely manner, follow at a safe distance, and change lanes appropriately.

The plaintiff blames the defendant for property damage to his car along with personal injuries requiring medical treatment for his daughter.

Alleging physical pain, mental anguish; impairment and disfigurement; lost use of the vehicle, diminished value of the vehicle, and medical expenses, Holland seeks over $20,000 in monetary relief, pre- and post-judgment interest; attorney’s fees; expenses, and costs. 

The plaintiff is represented by Guy Fisher of Provost*Umphrey in Beaumont.
