Father's Day trip results in accident, lawsuit

A Dallas County man and his two sons are suing over claims they were injured in a collision in Galveston during a Father's Day trip.

Arturo Torres, Arturo Torres Jr. and Dustin Hinton filed a lawsuit Oct. 24 in Galveston County District Court against Luis Guachichulca, citing negligence.

According to the complaint, on June 19, Arturo Torres and his sons, Arturo Jr. and Hinton, were driving in Galveston to spend Father's Day weekend together when they were injured in a collision.

The complaint states Torres Sr. was preparing to turn left from Avenue O onto southbound 27th Street, taking it slowly as he was not familiar with the streets, when Guachichulca pulled to the inside part of the left lane usually reserved for parking, and struck the driver's side of Torres' vehicle, pushing it farther into the intersection.

Torres says he and his sons were injured, and that Guachichulca is accused of negligence, negligence per se and gross negligence in turning improperly, passing in a no-passing lane, failing to yield right of way and passing on the shoulder.

The plaintiffs seek $350,000 in exemplary, property and other damages, including medical expenses, paint and suffering and interest.

They are represented by attorneys Chad Pinkerton, Benjamin R. Roberts and J. Josh Collum of The Pinkerton Law Firm in Houston.

Galveston County District Court case number: 14-CV-1141.
