Customer damaged rental property, company claims

A Galveston County company is suing over claims its rental equipment was damaged by a customer.

Galveston Rentals Inc. filed a lawsuit Oct. 24 in Galveston County District Court against American Villas.

According to the complaint, American Villas rented one Bobcat track loader from Galveston Rentals on June 16, and informed the plaintiff nearly two weeks later that one lift arm of the machine had been damaged. Galveston Rentals says it recovered the machine on the side of the road some distance from the job site on Eastseaside Drive in Beachtown and discovered it had been used for nearly 83 hours, which so damaged the lift arm as to require its $7,363 replacement.

The complaint states the contract holds American Villas liable for damage resulting from misuse, abuse or failure to properly maintain the equipment, but the defendant refuses to pay.

Galveston Rentals seeks actual damages, interest, attorney fees and costs of suit. It is represented by attorney Thomas W. McQuage of Galveston.
