Builder says contract was wrongly terminated

Breach of contract

A Galveston County builder is suing over claims a contract to build a home was unlawfully terminated.

JNP Acquisitions Inc. filed a lawsuit Oct. 15 in Galveston County District Court against Tony and Lezlie Smith, citing wrongful termination of a home construction contract.

According to the complaint, JNP entered into a contract with the defendants for the construction of a home on Ivy Road in Kemah on Nov. 11, 2013, and construction commenced. JNP says that as construction neared completion, the defendants notified the plaintiff that the contract was terminated two days previous, but this came after the defendants had been provided with a draw request for completed work. The complaint states the Smiths owe $63,480, and JNP says the termination of the contract constitutes a wrongful termination.

JNP seeks the amount owed and damages including attorney fees, interest and costs. It is represented by attorney Chuck Portz of Portz and Portz in Houston.
