Family files wrongful death suit against man's employer

The family of a man is suing over claims he was fatally injured at work.

Norma Lidia Andrade Ramirez, Enrique Ramirez, individually and as representative of the estate of Augustin Ramirez, deceased, Maria Cleofas Patlan Hernandez, Antonia Ramirez Patlan, Maria del Rosario Ramirez and Maribel Ramirez Patlan filed a lawsuit Dec. 4, 2014, in the Marshall Division of the Eastern District of Texas against: Simonds International Corporation, Bohler-Uddeholm Corporation, Bohler-Uddeholm Precision Strip, Bohler Brothers of America Inc., Bohler-Uddeholm Strip Steel in its assumed or common names Bohler-Uddeholm Information Services America Corporation, Bohler-Uddeholm Services or Bohler-Uddeholm Specialty Metals, Voestalpine AG, Voestalpine USA Corp., Voestalpine Bohler Welding USA Inc., Voestalpine Texas Holding, Voestalpine Texas, Voestalpine Specialty Metals, and Sturdell Specialty Metals.

According to the complaint, on Dec. 5, 2012, Augustin Ramirez was working around a large band saw at Nix Industries Inc. on SH-87 South in Timpson when the saw broke and struck Ramirez in the head, causing fatal injuries. The complaint states the defective saw and its steel components were designed, manufactured, and fabricated by the defendants, and they are accused of negligence, strict liability, breach of implied warranties.

The family seeks wrongful death damages. It is represented by attorneys Craig M. Sico and Roger S. Braugh Jr. of Sico, White, Hoelscher, Harris & Braugh in Corpus Christi, and Joel Brent Goudarzi of Goudarzi & Young in Gilmer.
