Buzbee Law Firm representing Mexican restaurant chain in $40M fraud suit

The Buzbee Law Firm in Houston is handling a $40 million fraud lawsuit, which alleges a construction company padded invoices while doing remodeling work for a Mexican restaurant chain.

Through attorney Tony Buzbee, El Tiempo Global LTD filed suit against MKWW Management on Wednesday, March 18 in Harris County District Court.

Between August 2013 and August 2014, El Tiempo made a series of payments to MKWW for services and materials rendered for the remodeling of a Mexican restaurant in Webster.

“Between the parties, there was a contract implied-in-fact,” the suit states. “Around April 2014, MKWW unilaterally terminated the contract between the parties.”

El Tiempo accuses MKWW of breaching its contract by terminating the arrangement and committed fraud by presenting invoices on behalf of third parties as representation of labor and materials furnished for the Webster restaurant project.

“MKWW fraudulently directed El Tiempo to pay invoices in an effort to direct El Tiempo’s construction money in the Webster location to other construction sites, to pay debts of other companies that own other restaurants, and pay large outstanding loans – including loans owed to a certain Don Knight,” the suit states.

“Plaintiff relied on these representations and invoices and have been damaged as a proximate result of their reliance.”

El Tiempo is suing for damages in an amount to be set at trial but no less than $10 million, plus exemplary damages in amount no less than $30 million.
