Jury selection has begun in a lawsuit alleging the plaintiff was sold a damaged boat.
As previously reported, Brian White filed a lawsuit Feb. 6, 2014, in the Jefferson County District Court against Watercraft Plus LLC and Eric W. Bourg, citing violations of the Texas Deceptive Trade Practices-Consumer Protection Act and Texas Business and Commerce Code.
The trial is expected to conclude before the week’s end, according to a courthouse official.
According to the original petition, on Nov. 30, 2012, White purchased a boat for $10,000 from Watercraft Plus. Prior to purchasing the boat, White claims he questioned Watercraft Plus employee Bourg if the boat had any damage and the defendants allegedly assured White the boat had no damage.
White maintains that soon after the purchase, he took the boat out and discovered there was a large crack in the hull he did not cause. He performed his own investigation and alleges the first owner damaged the boat’s hull.
White also alleges that Watercraft Plus was aware of the damage and Watercraft Plus had the hull inadequately patched to conceal the crack, according to the original complaint.
He accuses the defendants of making false representations regarding the boat’s condition.
White is seeking economic damages, additional damages in the amount of twice the economic damages, interest, fees and costs.
Attorney Roger N. Chrisco of the Chrisco Law Firm is representing the plaintiff in the case.
