Worker cites construction firms in door injury

An Orange County man has sued several commercial construction companies, alleging negligence.

Jason R. Thompson filed a lawsuit March 16 in Jefferson County District Court against: D & R Commercial Construction Services Inc.; T C Tile & Construction; Overhead Door Company of Beaumont; Sam’s East Inc.; and Set Construction Inc., alleging negligence and premises liability in a 2014 accident.

According to the complaint, in November 2014, Thompson, an employee of D & R or Set Construction, was assigned to work at Sam’s to remove debris and replace a damaged wall. His employer had been contracted by T C Tile. The suit states Thompson advised the defendant he could not complete the task because of an interior door spring that was under high tension and needed to be dismantled to complete the job safely.

The lawsuit says Thompson was advised Overhead Door would be responsible for removing the tension from the spring, and was asked to return to the worksite to continue the job Nov. 26, 2014. The suit states Thompson was informed the tension had been eliminated and he proceeded with the task on the basis of that information.

When Thompson removed the spring, the suit states, the spring shot loose, knocked the plaintiff to the ground and hit him several times, severing tendons and muscles and breaking several of his fingers, lacerating his chest, shoulder, face and head, and damaging his cheek nerves.

Thompson, who underwent emergency surgery, the suit states, has not worked since the accident. The suit alleges negligence and premises liability led to his serious and debilitating injuries. The plaintiff cites physical pain and suffering, mental anguish, medical expenses, impairment and disfigurement.

Thompson seeks: compensation for his injuries; pre- and post-judgment interest; attorney fees; expenses and costs. He is represented by attorney Lance Bradley of Bradley, Steele & Pierce in Port Arthur.
