Woman alleges injuries from fall at restaurant

A Galveston County woman has sued a restaurant and its owners for a 2014 fall, citing negligence.

Nina Quintero filed a lawsuit April 17 in Galveston County District Court against T-Bone Tom's Meat Market Steakhouse Restaurant Inc., Restaurants U.S. and T-Bone Tom's.

According to the complaint, on July 25, 2014, Quintero fell at the defendant restaurant, at 707 Highway 146, Kemah, and the fall, which "badly rolled her ankle and foot," was caused by "an unreasonably dangerous condition believed to be an uneven incline."

The suit says the defendants: failed to properly construct the walking area between a patio and restaurant, leading to an uneven incline; failed to guard customers from the unexpected change in elevation; failed to fix that walking surface; failed to warn Quintero of the dangerous condition; failed to adequately train employees to manage the premises; knew the incline's change in elevation posed a danger, evidence by the fading of a painted warning; and didn't light the area adequately so Quintero could notice the hazard.

The plaintiff cites monetary damages from physical injuries, pain and suffering.

Quintero seeks: damages to compensate for her medical care (about $75,000); her pain and suffering (about $195,000); physical impairment (about $195,000); loss of wages (about $150,000); court costs; and pre- and post-judgment interest. She is represented by attorney Scot G. Dollinger of Dollinger Law in Houston.
