Man alleges pounding by pugilistic pub patron

A Galveston County consumer brought suit against two taverns and an individual for alleged personal injuries in 2013.

Eric T. Eckler of League City filed against Mario S. Escamilla III, Union Tavern, Texas RMR, LLC, and Doc’s Upper Deck Sports Bar, all of Houston, in Galveston County District Court May 4, claiming gross negligence in a May 2013 incident.

The plaintiff, a patron of Union Tavern on or about May 15, 2013, alleges that he and Escamilla were asked to leave the premises at approximately 12:30 a.m. Once the men were outside, Eckler contends, Escamilla approached him and struck him violently in the vicinity of both establishments.

Eckler holds the bars responsible for Escamilla’s conduct; citing failure to maintain the area in a safe condition, warn customers of hazard, properly train staff and implement policy to protect patrons. Additionally, he cites that both businesses should have known that Escamilla was violent.

Citing pain and suffering, medical expenses, lost wages and earning capacity, and disability, the plaintiff seeks: compensation between $200,000 and $1 million; exemplary damages; pre- and post-judgment interest; attorney’s fees; expenses, and costs. Eckler is represented by James M. Lassiter III of Lassiter Law Frim in Houston.
