Collection firm initiates action on defaulting debtor

A Colorado company brought an action against a Jefferson County individual regarding a 2003 financial matter.

Cach LLC filed a petition against Mohammad Hamdan, of Beaumont, in Jefferson County District Court April 30, claiming specific infractions based on an August 2003 credit card account.

According to the filing, on or about Aug. 28, 2003 Bank of America N.A. issued a credit card in the defendant’s name. The defendant defaulted on his obligation to make monthly payments, and the card was canceled on or about June 30, 2012.

The account was charged off to profit and loss by Bank of America; ownership of the account was assigned to the plaintiff.

The suit states that the entire balance is due and payable in full in the amount of $3,706.39 and that the defendant has remitted no funds. Citing breach of contract, the complaint asserts that having accepted the credit card, the defendant became bound to pay for all charges incurred on his account, as well as being subject to all terms and conditions.

The plaintiff seeks: payment in the exact amount of $3,706.39; post-judgment interest, attorney’s fees, expenses, and costs.
