The children of a deceased Texaco, Inc. worker are suing their father's former employer for exposing him to asbestos dust and fraudulently concealing the situation.
Dana Wasser, Lana McCall and Jack Marcus Morgan, the surviving children of Jack Nelson Morgan, filed their lawsuit on March 27 in the Jefferson County District Court.
Judge Gary Sanderson, 60th District Court, will preside over the case.
The plaintiffs are represented by attorneys J. Keith Hyde and D'Juana Parks of the Provost & Umphrey Law Firm.
According to the siblings' petition, the elder Morgan was employed at the Port Arthur Texaco refinery � asserting that during his time there he was exposed to a variety of toxic materials, including asbestos dust and fibers. As a result, Morgan developed lung cancer and died "a painful and terrible death on Jan. 31, 2007."
The suit does not specify how long Morgan worked at the refinery.
The petition also states that Texaco knew for decades that their employees were being exposed to harmful products containing asbestos and did nothing to remedy the situation. "The defendant acted with malice�and gross neglect."
The children of the late Morgan "seek claims for all elements of damages allowable under the law including exemplary damages and seek to recover from the defendant an amount in excess of the jurisdictional limits of the court," the petition stated.
