Recent patent/copyright infringement suits filed in U.S. District Courts, Eastern District of Texas, June 1-5, 2007

Tyler Division:

June 4
Reedhycalog UK Ltd. et al vs. United Diamond Drilling Services Inc. et al
Plaintiff claims that U.S. Patent No. 6,861,098 was issued legally to inventors Nigel Dennis Griffin and Peter Raymond Hughes on March 1, 2005, for a Polycrystalline Diamond Partially Depleted of Catalyzing Material. The inventors assigned the patent to ReedHycalog LP.
The suit says United Diamond Drilling has infringed on the '098 patent and several others.
Plaintiff is represented by S. Calvin Capshaw of Brown McCarroll LLP of Tyler.
The case has been assigned to U.S. District Judge Leonard E. Davis.

Lonestar Inventions LP vs. Eastman Kodak Co.
Lonestar filed suit against Eastman Kodak for infringement of U.S. Patent No. 5,208,725 for a High Capicitance Structure in a Semiconductor Device.
The plaintiff says the patent was legally issued on May 3, 1993, to inventor Osman E. Akcasu. Akasu assigned the patent to Lonestar.
Lonestar is represented by Kurt M. Sauer of Daffer McDaniel LLP of Austin.
The case has been assigned to U.S. District Judge Leonard E. Davis.

Linex Technologies vs. Belair Networks Inc. et al
The plaintiff claims U.S. Patent No. 6,493,377 for Distributed Network, Spread-Spectrum System was issued to Linex on Dec. 10, 2002. Patent No. 7,167,503 for a Distributed Spread-Spectrum Network was issued Jan. 23, 2007. Linex claims Belair, Cisco and other companies manufacture and sell wireless systems that infringe on the patents.
The case has been assigned to U.S. District Judge David Folsom.

Linex Technologies vs. Belkin International Inc. et al
The plaintiff says it is the sole owner of U.S. Patent No. 6,757,322, issued June 29, 2004. The patent is for a Space Diversity and Coding, Spread-Spectrum Antenna and Method. Linex claims Belkin and other companies including Cisco and Toshiba manufacture and sell wireless network technology products incorporating multiple input/multiple output technology.
Linex is represented by Thomas J. Ward Jr. of Longview.
The case has been assigned to U.S. District Judge Leonard E. Davis.

Abstrax Inc. vs. Dell Inc. et al
Plaintiff Abstrax claims it owns the invention described in U.S. Patent No. 6,240,328 entitled Manufacturing Method for Assembly Products by Generating and Scheduling Dynamically Assembly Instructions. Defendants use the methods to manufacture computers without a license or permission from plaintiff, the suit claims.

The case has been assigned to U.S. District Judge David Folsom.

Retail Acquisition and Development Inc. vs. Naschem Company Ltd. et al
U.S. Patent No. 7,118,241 and 7,163,309 were issued to Dae Up Sohn, CEO of Naschem Co. of South Korea. The patent for a Clip Type Light Emitter was issued Oct. 10, 2006. Naschem previously sued Cap-Light Distributing for infringement of '241 and '309. Retail Acquisition says that it has not infringed, and that the patents are invalid and that Naschem has created a reasonable apprehension of suit for infringement with respect to plaintiff's ability to make, use or sell at least some of its products.
Plaintiff is represented by Eric Hugh Findlay of Tyler.
The case has been assigned to U.S. District Judge T.J. Ward.

Minerva Industries Inc. vs. Motorola Inc. et al
Minerva Industries has filed a lawsuit against 43 companies for infringement of its patent issued Jan. 20, 2004, for a Mobile Entertainment and Communication Device. Minerva claims Motorola, Nokia, Alltel, Sprint Nextel, T-Mobile, Verizon, Samsung and other companies have committed acts of patent infringement on Patent No. 6,681,120 and others.
Otis W. Carroll of Tyler is representing Minerva.
The case has been assigned to U.S. District Judge T. John Ward.
