Couple sues for Rita claim

A Beaumont couple, whose home was damaged when Hurricane Rita struck the Golden Triangle area, is suing their insurance provider and two of its adjusters for denying their property damage claim.

Ronal and Kameko Brister filed their breach of contract lawsuit against National Lloyds Insurance Co., Compass Adjusting Services Inc., and Kerri Tuley and Melvin Babb with the Jefferson County District Court on July 23.

According to the plaintiffs' original petition, after Rita hit, the couple filed a property damage claim for roof, water, wind and structural damage with National. The insurance company sent adjusters Tuley and Babb who denied the Bristers' claim.

The couple claims National misrepresented their policy to them and failed to settle their claim in a fair manner.

"Defendants wrongfully denied plaintiffs' claim for repairs of the property, even though the policy provided coverage for losses," the suit said. "National failed to perform its contractual duty to adequately compensate plaintiffs under the terms of the policy."

The Bristers charge National with several violations of the Texas Insurance Code, breach of the duty of good faith and fair dealing and fraud.

They are suing for compensatory damages and economic hardship.

The plaintiffs are demanding a trial by jury and are represented by attorney Steve Mostyn of the Mostyn Law Firm.

Judge Milton Shuffield, 136th Judicial District, will preside over the case.
