Couple seeks $2.75 M after tire falls off

MARSHALL –Driving only a few minutes and a short distance from the Wal-Mart where Jerry and Maxine Freudiger had two new tires installed, the couple says the right front wheel came off their truck. Jerry Freudiger claims he was seriously injured in the incident, and they are seeking $2.75 million from the retailer.

The Freudigers filed a products liability suit against Wal-Mart on Nov. 8 in the Marshall Division of the Eastern District of Texas.

According to the original complaint, on Oct. 27, 2006, the couple bought two new front tires from a Mt. Pleasant Wal-Mart, which were installed at the time of sale. Just a few minutes after getting the new tires installed, the plaintiffs state the right front wheel came off their truck.

The complaint states Jerry Freudiger was seriously injured during the incident due to Wal-Mart's improper installation of the tire. The complaint does not detail how he was injured.

The plaintiffs state Wal-Mart "sold an unreasonably dangerous product, breached express and implied warranties, committed acts and omission of negligence" which caused their personal injuries and damages. Other damages sought include loss of consortium, court costs, and pre-judgment interest.

Jury trial is demanded.

Wal-Mart has not responded to the allegations.

Judge T. John Ward is assigned to the case.
